1. GENERAL PROVISIONS

1.1. This Privacy Policy governs the collection, storage and use of the personal data collected on website https://an.pro, hereinafter – the Portal.

1.2. Portal is being administered by ANPRO PTE. LTD company established and operating in accordance with laws of the Singapore, registration No. 201725335D, legal address 68 Circular Road #02-01, Singapore, 049422, e-mail address [email protected] hereinafter - the Data Controller.

1.3. We protect and take care of the privacy and protection of personal data of visitors of the Portal. We undertake to respect your right to lawful processing and protection of personal data as well as to comply with the applicable laws and regulations on the protection of personal data — General Data Protection Regulation (GDPR) and other laws and regulations if such are applicable to data processing.

1.4. This Privacy Policy provides information on the way the Data Controller collects and processes the personal data of visitors of Portal.

1.5. By accessing the Portal, you confirm that you have read and understood this Privacy Policy.

2. PERSONAL INFORMATION WE COLLECT

2.1. The Personal Information within the meaning of this Privacy Policy are the User Information, Device Information and Order Information together.

2.2. We collect, store and use the following User Information - e-mail address, password, name and surname, photo and other provided information.

2.3. We collect, store and use the following automatically-collected information, hereinafter - Device Information:

2.3.1. When you visit the Portal, we automatically collect certain information about your device, including information about your web browser, IP address, device model, screen size, time zone, geographic location and some of the cookies that are installed on your device. 

2.3.2. Additionally, as you browse the Portal, we collect information about the individual web pages or products that you view, what Portals or search terms referred you to the Portal, and information about how you interact with the Portal. 

2.4. We collect Device Information using the following technologies:

2.4.1. “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier;

2.4.2. “Log files” track actions occurring on the Portal, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

2.4.3. “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Portal.

2.5. When you make a purchase or attempt to make a purchase through the Portal, we collect certain information you provide, hereinafter - Order Information, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number.

2.6. Additionally, we collect following User Information:

2.6.1. Information you provide to apply for receiving newsletters;

2.6.2. Information you provide to register;

2.6.3. Information on any transactions between you and the Data Controller (including information about the orders);

2.6.4. Any other information you provide or wish to send to us.

2.7. If you want to contact us, we collect the data that will be specified in the contact form on the Portal or the information specified in your e-mail if you send an e-mail.

3. HOW DO WE USE YOUR PERSONAL INFORMATION

3.1. We use User Information to ensure the functionality of the Portal and to show our visitors your profile as a verified architectural specialist.

3.2. We use the Order Information that we collect generally to fulfil any orders placed through the Portal (including processing your payment information and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

3.2.1. Communicate with you;

3.2.2. Reply to your information queries;

3.2.3. Screen our orders for potential risk of fraud or other offences; and

3.2.4. When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

3.3. We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Portal (for example, by generating analytics about how our customers browse and interact with the Portal, to assess the success of our marketing and advertising campaigns, to provide the best possible visual and technical experience for your specific device model, screen size and internet browser).

4. COOKIES POLICY

4.1. Cookies are small text files that can be used by Portals to make a user's experience more efficient.

4.2. We use short-term (Session) and long-term (Persistent) cookies. 

4.2.1 Session cookies allow us to track your actions during a single browsing session, but they do not remain on your device afterwards. 

4.2.2 Persistent cookies remain on your device between sessions. We use them to authenticate you and to remember your preferences.

4.3. We also use third party cookies for the purpose of ensuring secure and comfortable operation of the Portal, as well as for the purposes of generation of internal statistics, i.e. in order to find out more details about the visitor’s operations at the Portal and to analyse the visitors’ user experience.

4.4. These cookies are mandatory for the full operation of the Portal, however, we also use cookies that are non-mandatory, so you are able to reject them. In this case the Portal will be loaded without containing the code which activates these non-mandatory cookies.

4.4.1. As non-mandatory cookies we use the “Google Analytics” service, which sends user tracking data to the Google servers. In its Privacy policy Google prohibits the transmission of personally identifiable information, so we invite you to accept the usage of these non-mandatory cookies. 4.5. You can at any time change or withdraw your consent from the Cookies Policy on our Portal.

5. SHARING YOUR PERSONAL INFORMATION

5.1. We share your Personal Information with third parties to help us use your Personal Information, as described above. For example:

5.1.1. we use Stripe (https://stripe.com) to power our online payment system;

5.1.2. we use Veriff (https://www.veriff.com) to make your data and Profile verification;

5.1.3. we share your data with our cooperation partners whose services you apply by using the Profile created on the Portal, for example when using the Profile to participate in architectural competitions organized by Buildner (https://architecturecompetitions.com).

5.2. We also use Google Analytics and Facebook Pixel to help us understand how our customers use the Portal.

5.3. We may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

5.4. We also export your information to the European Union (for example, to our partner company Buildner, operating in Andorra) and to the United States of America.

5.5. Your information will not be disclosed to third parties except for above-mentioned cases and cases where we will have received your explicitly stated consent or where the disclosure of information is requested in accordance with laws and regulations.

6. BEHAVIOURAL ADVERTISING

6.1. As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. 7. DO NOT TRACK

7.1. Please note that we do not alter our Portal’s data collection and use practices when we see a Do Not Track signal from your browser.

8. YOUR RIGHTS

8.1. If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us by e‑mail at [email protected]

8.2.  Additionally, if you are a European resident, we note that we are processing your information in order to fulfil agreements we might have with you (for example if you make an order through the Portal), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred to the European Union, Andorra, Singapore, and the United States of America.

9. DATA RETENTION

9.1. We will maintain your Personal Information for our records unless and until you ask us to delete this information.

9.2. Additionally, please note that we may not delete information that is required to be maintained by the laws.

10. SECURITY OF YOUR DATA

10.1. We seek to ensure the protection of your Personal Information, therefore, this Portal is protected by appropriate means designed for the protection of information beyond our control against loss, malicious use or modification. 

10.2. Although we apply security measures to protect confidential information and ensure appropriate security, we do not guarantee that the information transmitted over the internet is safe or that such transmissions will not be subject to delay, disturbance, interception or error.

11. LINKS TO OTHER PORTALS

11.1 Please note that our Privacy policy will not apply to other Portals that you may get to via a link from our Portal.

12. PRIVACY POLICY ADDENDUM FOR CALIFORNIA RESIDENTS

12.1. Under the California Consumer Privacy Act, hereinafter – CCPA, California residents are afforded certain rights about the Personal Information (as such capitalized term is defined under the CCPA) we have collected about them, which we have described in more detail below.

12.2. We are both a “business” and a “service provider” under the CCPA, depending on how you interact with us. This section applies only to personal information we collect in our role as a business. Where we act on a Merchant’s behalf to fulfil an order with regard to the Merchant’s customer, we are a Service Provider under the CCPA. Please read the Merchant’s privacy policy for further information on how to exercise your rights under the CCPA. The Merchant is your contact for any questions you have about how it handles your Personal Information.

12.3. Above we have described the categories of Personal Information that we have collected and shared over the past twelve (12) months, the purposes for such collection and the types of entities with whom we have shared such information.

12.4. If you are a California resident, the processing of certain personal information about you may be subject to the CCPA. Where the CCPA applies, this section provides additional privacy disclosures and informs you of key additional rights as a California resident. We will never discriminate against you for exercising your rights, including providing a different level or quality of services or denying goods or services to you when you exercise your rights under the CCPA.

12.5. Under the CCPA, California residents have a right to request information about our collection, use, and disclosure of your personal information over the prior twelve (12) months, and ask that we provide you free of charge with the following information: 

12.5.1. the categories of Personal Information about you that we collected;

12.5.2. the categories of sources from which the Personal Information was collected;

12.5.3. the purpose for collecting Personal Information about you;

12.5.4. the categories of third parties to whom we disclosed Personal Information about you and the categories of Personal Information that was disclosed (if applicable) and the purpose for disclosing the Personal Information about you; and

12.5.5. the specific pieces of Personal Information we collected about you.

12.6. Under the CCPA, you also have a right to request that we delete personal information, subject to certain exceptions. 

12.7. You may request that we not sell your Personal Information. Please note, however, that CCPA defines “sale” very broadly, and includes “selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a California consumer’s Personal Information by the business to another business or third party for monetary or other valuable consideration.” We use services that help deliver interest-based ads to you and may transfer Personal Information to business partners for their use. Making Personal Information (such as online identifiers or browsing activity) available to these companies is considered a “sale” under the CCPA.

12.8. If you are a California resident to whom the CCPA applies, you may contact us to exercise your rights:

12.8.1. To request or delete data, log in to your User’s account, or complete this form if not registered on Portal.

12.8.2. Once we receive your request, we will review it, determine whether we can verify your identity, and process the request accordingly. We may need to collect information from you to verify your identity, such as your email address, government issued ID or date of birth. You may make a verifiable consumer request to access your personal information twice per twelve (12) month period. We aim to fulfil all verified requests within 45 days pursuant to the CCPA.  If necessary, extensions for an additional 45 days will be accompanied by an explanation for the delay.

12.8.3. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof that you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.

13. CHANGES

13.1. We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.

14. MINORS

14.1. The Portal is not intended for individuals under the age of 18.
